ACT Government introduces legislation to guarantee statutory lump sum benefits for workers with fatal asbestos diseases

The ACT Government has today agreed to guarantee statutory lump sum benefits and streamline claims handling for workers’ who have been diagnosed with an imminently fatal asbestos related disease.

“I am pleased to announce the ACT Government’s support to improve the process and outcomes for workers’ who suffer from an imminently fatal asbestos related disease,” Minister Gentleman said. 

“The current workers’ compensation scheme for private sector Territory workers is not equipped to provide full and timely access to compensation for individuals living with an asbestos disease. 

“The ACT Government has recognised this inequity and the need to ensure that workers are supported and justly compensated at such a vulnerable time.   Amending the Workers Compensation Act 1951 to improve access to compensation for workers and guarantee statutory lump sum benefits will remedy this.

 “The Workers Compensation Amendment Bill 2016 commences on 1 July 2017 and is yet another example of the ACT Government’s commitment to ensuring that people whose lives have been impacted by asbestos receive the support they need.

This legislation helps expedite the process which Bernie Banton and others experienced attempting to gain compensation for employment related asbestos diseases. Claimants will be able to achieve finality from their end before they pass away” said Minister Gentleman. 

An injured worker with an imminently fatal asbestos related disease is entitled to receive up to $140,505 to help with rehabilitation costs, medical expenses, and home modifications.
