Shutdown of building site a timely reminder

The recent partial closure of a local building site has highlighted the need for home buyers who purchase off the plan to be aware of the conditions and approvals of the contracts they sign.

As part of Access Canberra's program of proactive audits of Canberra building sites, a site was partially closed following a visit by Access Canberra inspectors.  Their inspection discovered that certain aspects of the building work were inconsistent with the Building Certifier's approved plan. 

Consequently, a partial stop notice was issued on the construction works.  Officers of Access Canberra and the Environment and Planning Directorate are now working closely with the builder and the building certifier to ensure that all relevant details are submitted and approved prior to work recommencing.

“Access Canberra’s proactive audit program is achieving positive outcomes for both local home buyers and builders.  Detecting breaches of building approvals early in a project’s life ensures that any work being carried out is in accordance with the plan and the necessary approvals,” said Commissioner for Fair Trading, David Snowden.

“It certainly helps to ensure the quality of the construction, and can ultimately save the builder money if costly rectification work is required once the project is completed.

“This incident was a timely reminder to consumers who decide to purchase an apartment or house off a plan to be aware of variation clauses in contracts.

“Consumers should get legal advice before entering into a contract to purchase a property. It is important to understand a contract may permit the builder to make variations during construction and how any variations may impact on the dwelling,” Mr Snowden said.
