The ACT Director of Public Prosecutions (DPP) has discontinued the prosecutions against the defendants in relation to the death of young construction worker, Ben Catanzariti, in July 2012.
“The DPP made the difficult decision due to an unforeseen change in the evidence surrounding the reason for the collapse of the concrete boom that resulted in Mr Catanzariti’s tragic death,” said the acting ACT Work Safety Commissioner, Brett Phillips.
“Three expert theories were provided as to the cause of the bolt failure with variations in the advice received. As a result, the DPP has concluded that it cannot prove the case beyond reasonable doubt, and there are no reasonable prospects of convictions.
“The decision was considered carefully and not taken lightly. Mr Catanzariti’s death remains keenly felt and WorkSafe will continue to support the Catanzariti family in any way it can,” Mr Phillips said.
“WorkSafe remains firmly committed to the ongoing safety of workers in the ACT and will continue to vigorously implement the recommendations of the ‘Getting Home Safely’ report.
“The reasons for the DPP’s decision to discontinue the matter are available at the ACT DPP’s website.”
The Coroner will be informed and will determine whether a Coronial Inquest will take place into the circumstances of Mr Catanzariti’s death.
