About determinations

Formal decisions made by the Remuneration Tribunal are called determinations. When determinations by the Tribunal are presented in the ACT Legislative Assembly, the Assembly has no power to change or reject a determination. Determinations made by the Remuneration Tribunal and tabled in the Legislative Assembly are legislative instruments.
The Tribunal considers many things when making a determination, including:

• the scope of the Tribunal's legislative role and responsibility
• the nature of the work performed by the public office
• submissions received by public officials, the Government and the public
• the economic environment
• remuneration paid to similar public officials, the Government and the public
• entitlements provided to public officials through other legislative instruments, for example
  Directors-General, Executives and full time Statutory Office Holders receive a vehicle
  entitlement under the Public Sector Management Standards 2006

As the Tribunal is an independent entity, it is accountable only for its legislative role and responsibilities and it is not compelled to accept the recommendation of another person or entity. The Tribunal will decide on a case by case basis how best to respond to the information presented to it.
